Immigration and Refugee Board (IRB) is on the top when it comes to options for appeals by a Refugee or a Permanent Resident.

Following are the responsibilities of IRB

  • It holds the detention reviews
  • Determines if the person may be allowed to enter or remain in Canada through admissibility hearings
  • It also decide on refugee claims made in Canada
  • Hearing and decisions on appeals about immigration

IRB has four wings namely

  • Immigration Appeals Division (IAD)

It hears appeals on the following matters

  • Rejected family class sponsorship
  • If there is a removal order of Permanent Resident or Protected Person
  • Relating to residency obligations
  • CBSA

Immigration Division (ID)

It hears appeals on the following matters

  • Immigration hearings
  • Holds detention reviews

Refugee Appeal Division (RAD)

It hears appeals on the following matters

  • It decides on appeals of decision made by RPD to whether allow or reject a refugee claim

Refugee Protection Division (RPD)

It hears appeals on the following matters

  • It decided on refugee claims made in Canada
